Welcome to Fiato Digital Solutions (“Fiato”, “we”, “our”, or “us”). By accessing or using our platform, website, mobile application, APIs, or any of our services (collectively, the “Platform”), you (“User”, “you”, or “your”) agree to comply with and be bound by these Terms of Use (“Terms”).

Please read these Terms carefully before using our services. If you do not agree, do not use the Platform.


1. Overview

Fiato Digital Solutions is a financial technology company providing payment infrastructure and settlement solutions for individuals and businesses. Through our services, users can send, receive, and settle payments using cryptocurrency and fiat currency, manage transactions securely, and use vouchers for payments or supported services.


2. Acceptance of Terms
  • (a) You acknowledge that you have read, understood, and agreed to these Terms.
  • (b) You confirm that you are at least 18 years old and legally capable of entering this agreement.
  • (c) If using Fiato on behalf of an organization, you confirm that you are authorized to bind that entity to these Terms.

3. Account Registration and Verification

Users must register an account, complete KYC verification, and maintain confidentiality of login credentials. Fiato reserves the right to suspend or reject accounts that provide false or misleading information or fail compliance checks.


4. Use of Services

4.1 Permitted Use
  • (a) Accepting and making payments through approved methods.
  • (b) Using vouchers for legitimate purchases and bill payments.
  • (c) Conducting settlements in compliance with financial regulations.

4.2 Prohibited Use
  • (a) Money laundering or terrorist financing.
  • (b) Fraudulent, deceptive, or illegal activities.
  • (c) Transactions involving prohibited goods or services.
  • (d) Interference with the security or functionality of the platform.

5. Transaction Processing

Transactions are processed through secure networks and are irreversible once confirmed. Users must ensure wallet addresses, amounts, and references are correct. Fiato is not liable for user errors, delays, or third-party issues.


6. Fees and Charges

Fiato may charge fees for transaction processing, settlements, or voucher services. Fees will be transparently displayed and may change periodically, with continued use implying acceptance.


7. Compliance and Monitoring

Fiato adheres to Nigerian AML/CFT regulations. All transactions may be reviewed, and accounts may be frozen or reported if suspicious activity is detected. We cooperate with authorities when legally required.


8. Intellectual Property Rights

All trademarks, branding, and code on the Fiato platform belong to Fiato Digital Solutions. Users may not copy, modify, or reverse-engineer any part of the platform.


9. Data Protection and Privacy

Fiato complies with the Nigeria Data Protection Regulation (NDPR). Personal data is collected and processed for verification and compliance. See our Privacy Policy for details.


10. Service Availability

While Fiato strives for uninterrupted operation, we do not guarantee constant availability. Maintenance, downtime, or third-party issues may affect access temporarily.


11. Limitation of Liability

Fiato is not liable for indirect, incidental, or consequential damages arising from use of the platform. Our total liability shall not exceed fees paid for the relevant transaction.


12. Suspension and Termination

Accounts may be suspended or terminated for violating these Terms, legal requirements, or suspicious activity. Upon termination, you remain liable for prior obligations.


13. Dispute Resolution

Disputes shall first be resolved amicably. If unresolved, arbitration shall take place in Lagos, Nigeria, under the Arbitration and Conciliation Act, in English.


14. Changes to Terms

Fiato may modify these Terms at any time. Updates will be posted with effective dates. Continued use constitutes acceptance of the updated Terms.


15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.
